Forensic Consultations and Reports

Court mandated forensic reports are typically used for criminal, civil or family law matters. A Magistrate or Judge may request a report to shed light on mental health issues/disorders or problem behaviours. Report writers are necessarily independent of relevant proceedings, and will address the specific factors identified the referral.

In relation to criminal law matters, forensic reports can be drafted as a pre-sentence report, or to determine whether the defendant is fit to stand trial. Forensic reports are also used when the defendant pleads not guilty by way of mental illness. A significant aspect of pre-sentence reports is a risk assessment to determine the offender’s likelihood of reoffending.

In relation to civil law matters, court mandated forensic reports are often used for personal injury matters (e.g., workplace injury, motor vehicle accidents) and NCAT matters in relation to capacity to approve documents such as wills and powers of attorney.

In relation to family and children's law matters, forensic reports may assist a court to determine whether a parent or prospective carer has the capacity to take care of a child. Such reports are often used in the family law courts and children's courts.
